Highway Department: Lake County Issues Public Notice for Eminent Domain Proceedings - The Monzer Children's Revocable Trust Property

Lake County is proceeding with eminent domain action under Cause No. 45D02-2506-PL-000329 to acquire property from The Monzer Children's Revocable Trust. A Publication Summons and Notice of Filing has been issued as the court was unable to obtain a direct address for service. The defendant has the right to object to the condemnation proceedings under Indiana Code 32-24-1-8. Any objections must be filed in writing with the Lake County Superior Court Civil Division 2 within thirty (30) days of notice service. The court may extend this filing period by an additional thirty (30) days upon written motion. Defendants may object on grounds including lack of court jurisdiction, plaintiff's lack of authority to exercise eminent domain power for the intended use, or other reasons disclosed in the complaint.
